The maximum penalty, in the absence of mitigating factors, is the same as the minimum, with the exception of an increase in jail time of up to 6 months and a fine of $2,500, with an 85% surcharge.
A felony aggravated DUI carries more extreme penalties, a first time aggravated DUI can result in a maximum prison sentence of 3.75 years, a 3-year license revocation and a $150,000 fine, with an 84% surcharge. The minimum penalty for felony DUI includes 4 months in state prison as a term and condition of probation. Subsequent violations will usually result in harsher punishments.
