MVD Hearings

In the event that you have been charged with a DUI in the State of Arizona, you will have 15 days from the date of your arrest to request a hearing with the Motor Vehicle Division (MVD). At this hearing, it will be decided whether or not you are able to maintain your driving privileges subsequent to your DUI arrest. If you fail to request this hearing within the 15-day limit, you could face an automatic license suspension that lasts for a minimum of 30 days. If a hearing is scheduled, an MVD administrative law judge will review your case, where proof of your intoxication must be presented. This proof can be provided by law enforcement testimony, the results of breath and blood alcohol tests, or the results of the sobriety test that was administered at the time of the DUI stop. The hearing will result in the automatic suspension of your driving privileges if the following can be proven:

  • You were both arrested and charged with DUI.
  • The officers who stopped you had valid suspicion and legal grounds for determining that you were under the influence of alcohol or drugs.
  • You refused any test that measures your blood alcohol content.
  • You were fully aware of the consequences of such a refusal.
