In Arizona, DUIs can be charged as felonies if you have at least two prior felony convictions within eighty-four months of a current allegation, or if you're driving on a suspended, revoked, or cancelled license at the time of the DUI, or if you have someone of the age of fifteen in the vehicle. For a suspended license DUI or a DUI with priors, you're looking at what's called a class 4 felony. That's a felony that's punishable with imprisonment for a presumptive term of two years and a half years. However, if it's a first offense probation can be available. If placed on probation the judge would still have to sentence you to four months in the Arizona department of corrections as a term of condition of your probation. If they allegation is a DUI while having an occupant in the car who's under the age of fifteen, those DUIs are punishable against the standards of the misdemeanor DUI although it can remain a felony on your record.
