Misdemeanor DUI

A misdemeanor DUI is made up of certain legal elements. Legal elements are the factors that the government must prove in a court room in order to get a person convicted. For a misdemeanor alcohol based DUI, you have three primary elements: driving a vehicle after consuming alcohol, if the alcohol impairs your ability to operate the vehicle to the slightest degree, we call this the A1 DUI. Second type of DUI is the blood alcohol level where it doesn't look at driving but only at your BAC level or blood alcohol content level. For a first offense, standard DUI, the elements would be driving a car after consuming alcohol if your blood level was greater than .08 as measured by blood, breath, or urine within two hours of driving.
